The Collapse of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension triggered by the introduction of a new comprehensive peace framework for resolving the conflict appeared – briefly – to have been stabilised. A American diplomat spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its retaliation: another massive barrage of missile and drone strikes on Kyiv.

The Pattern of Diplomacy and Destruction

The chain of opposing developments captured the harsh reality of the current period. By day, political struggles are fought: optimistic declarations are issued from different nations. Immense energy is devoted on restraining specific proposals. By night, Russian leadership clearly shows the world that, for them, military action persists as the key method for achieving "peace".

Nocturnal Warfare

As military strikes progressed into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was exposed. Ukraine is able to track rocket firings from across the border, a capability afforded by current data. From observation points, Ukrainian air force fighter jets that had been scrambled to counter approaching aerial threats roared overhead – sophisticated military planes delivered to Ukraine by NATO members.

Soon thereafter, Kyiv's anti-aircraft weapons thundered: several firings fired to intercept a Russian ballistic missile. This was a sophisticated defense system at work, probably provided by Western nations. Every firing jolts you unexpectedly, shaking the windows. The instant of fear quickly becomes sober acceptance: possibly the hostile projectile won't cause damage this time, sparing the city from devastation and additional electricity failures.

Continuous Dangers

Soon after, a heavy machine gun engaged a unmanned aircraft in the vicinity, part of a defensive team – probably allied-provided weaponry. Sadly, the bullets missed the hostile drone – it pressed on overhead toward its objective.

With pauses, this persisted until dawn. Kyiv greeted the morning news: multiple fatalities, damage and heating outages in multiple buildings as a result of the nocturnal offensive. As typically, everyone still went about their day – living the war. But those full day demonstrated Ukraine's critical military reliance on Western support – a reliance that neighboring countries are demonstrably unable to fill in the immediate future.

Unsuccessful Negotiations

The detailed framework from US administration generated strong feelings, discussion and profound anxiety – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after earlier high-level meetings and bilateral conferences.

Every new proposal from US leadership unfolds according to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, effectively counters. They stabilise the situation but never actually secure success. This pattern will, no doubt, persist.

Strategic Calculations

It is convenient to criticize particular leaders of persistently promoting Kremlin's demands. But that does not seem to be the complete picture. Washington functions according to a premise understood by seasoned negotiators: you cannot win at the negotiating table what you have failed to defend militarily. The US administration believes that it is unfeasible to pressure the Kremlin to surrender the land that it currently occupies in Ukraine's southern or eastern regions.

The challenge is that while accepting these circumstances, US leadership does minimal to discourage Russia, through diplomacy or military means, from thinking that the current condition will not change more in its favour in the coming year.

Conflicting Perspectives

Therefore, the Kremlin is certain that the clock favors them – that Ukraine and its partners are approaching exhaustion. Their incentive to sign a deal that does not give them the largest achievable advantage is close to zero. There may be multiple initiatives to stop fighting, but they will persist as long as Russia's leader remains highly assured in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still persist, slowly losing civilians and areas but preventing a complete military breakdown until conditions improve in its benefit.

Present Conditions

Objectively, there are no real preconditions for a truce. Now, subjective factors are coming into play: personal goals to negotiate peace and obtain worldwide acknowledgment, and Kyiv's dual difficulties – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the national cause against any proposal Kyiv finds unworkable, so that their focus does not switch to domestic problems. And although their mission will now be considerably more difficult after recent developments, it remains very improbable that this will change their overall approach.

These two forces are influencing discussions.

Summary and Prospects

It took a only one week to kill the suggested clauses of the most recent proposal. Assertive and inconsistent approach of the matter by American leadership, opposition by Ukraine and the other European countries, along with calming attempts of negotiators, and finally, latest revelations, all achieved their purpose.

While new plans based on previous concepts are imminent, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are rooted in Kremlin requirements and show certain reluctance to change the course of events, if they stand together and enhance their military capacity at a much faster pace. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the foreseeable future, largely rely on sustained allied backing.
